These Terms of Use (“Terms”) govern your access to and use of the ViO TORUS mobile application and related services (the “Service”) operated by ViO TORUS (“we”, “us”). Please read them carefully. By downloading, accessing, or using the Service, you agree to these Terms and our Privacy Policy.

1. The Service

ViO TORUS provides wellness and relaxation audio content (soundscapes, playlists, and sessions) for personal, non-commercial use. The Service may allow browsing as a guest and additional features when you sign in with Google or Apple.

2. Not medical advice

Important: The Service is for general wellness and relaxation only. It does not provide medical advice, diagnosis, treatment, or emergency services. Do not use the Service as a substitute for professional healthcare. If you have a medical emergency, contact local emergency services immediately.

3. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under 18, you should use the Service with parental or guardian permission where required by law.

4. Accounts

• You are responsible for activity under your account and keeping your device secure.
• Sign-in is provided through third parties (Google, Apple). Their terms also apply.
• You must provide accurate information and not impersonate others.
• We may suspend or terminate accounts that violate these Terms.

5. Acceptable use

You agree not to:

• Copy, redistribute, or publicly perform content from the Service except as allowed in the app
• Reverse engineer, scrape, or abuse our APIs or infrastructure
• Use the Service for unlawful, harmful, or fraudulent purposes
• Interfere with other users or overload our systems

6. Content and intellectual property

All audio, artwork, trademarks, and software in the Service are owned by ViO TORUS or our licensors and are protected by copyright and other laws. We grant you a limited, non-exclusive, non-transferable license to stream and use the content for personal use within the app.

7. Premium and purchases (if offered)

Some content or features may require a paid subscription in the future. Prices, billing periods, and cancellation rules will be shown in the app and on the applicable app store (Apple App Store / Google Play) at the time of purchase. Store billing terms apply to payments processed by Apple or Google.

8. Guest mode

Guest features may store data locally on your device. That data may be lost if you uninstall the app or clear storage. Signing in may sync eligible data to your account as described in the Privacy Policy.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIO TORUS AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) USD $50.

11. Indemnity

You agree to indemnify and hold harmless ViO TORUS from claims arising out of your misuse of the Service or violation of these Terms, to the extent permitted by law.

12. Changes to the Service and Terms

We may modify or discontinue features at any time. We may update these Terms by posting a new version on this page. Material changes may be notified in the app where appropriate. Continued use after the effective date constitutes acceptance.

13. Termination

You may stop using the Service at any time and request account deletion via viotorus.team@gmail.com. We may suspend or terminate access if you breach these Terms or for legal, security, or operational reasons.

14. Governing law

These Terms are governed by the laws of Vietnam, without regard to conflict-of-law rules. Courts in Vietnam shall have exclusive jurisdiction, unless mandatory consumer protection laws in your country require otherwise.
